Estate Planning

At Nachtigal, Eisenstein & Associates, our estate planning lawyers create estate plans to meet the goals of our clients, who range from young couples who need a will to designate a guardian for their children, to people who are planning for retirement, to wealthy individuals who are concerned about estate taxes, to elderly people who want to create legal documents to enable a trusted relative to make health care and financial decisions for them if they become incapacitated.

We use a number of estate planning tools to meet your goals, including wills, trusts, advanced health directives and durable powers of attorney.

  • Wills
A will is the document you create to direct the final distribution of your assets when you die. For couples with minor children, a will also designates a guardian to take care of your children if you and your spouse should both die before your children are adults.
  • Living Trust
A living trust can be used to avoid, minimize or eliminate estate probate costs for anyone.
  • Advanced health directive
An advanced health directive (called a living will in some states) informs hospitals, doctors and other care providers if you do not want artificial, life-prolonging techniques (such as feeding tubes) if you are terminal condition without hope of recovery. Your advanced health directive also designates a trusted person to make health care decisions for you if you are no longer able to communicate those decisions for yourself.
  • durable power of attorney
A durable power of attorney allows you to give a trusted person the ability to pay your bills and handle your financial affairs if you are incapacitated.

We will also help you revise and update your estate plan if your needs change as a result of starting a business, your buying property, and divorce. We will use our expertise in a broad area of law to help you protect your assets.
