Estate Administration

In Oregon, probate generally serves two main purposes. The first is to determine whether or not the person died with a valid will. Secondly, probate determines who will be responsible for paying bills and distributing the deceased's assets to beneficiaries. This person is known as a Personal Representative if a person dies with a will and an administrator if a person dies without a will (also known as intestate).

If you have been named the executor or administrator of someone's estate, it's important to consult a law firm with expertise in this area of the law. Legal advice and guidance can expedite the probate process, prevent costly errors, and protect against the executor or administrator being sued.

Protect Estate Assets

At Nachtigal, Eisenstein & Associates, our probate lawyers represent executors and administrators of estates for people who die with wills and without wills (called intestate). We also help protect beneficiary rights in will contests.

Estate administration consists of settling claims against the estate, collecting and protecting estate assets, and distributing assets to the decedent's beneficiaries according to the provisions of the will. If a person dies without a will, assets are distributed to heirs according to a statutory formula.

Our probate attorneys also help families in guardianship and conservatorship proceedings to designate someone to handle financial and health care decisions for an incapacitated person.

We will use our expertise in a broad area of law to protect your interests when probating assets such as businesses and property.
