Under Oregon law, the probate courts serve two main purposes. The first is to determine whether or not the person died with a valid will (testate). If no will is in place (intestate), the court must decide upon the distribution of assets. If heirs cannot be located, the property could pass to the state of Oregon.

The second purpose for probate is to determine who will be responsible for paying bills and distributing the deceased's assets to beneficiaries from trusts and other financial accounts. This is often referred to as estate administration. If a will is in place a personal representative will be assigned to the beneficiaries. If no will is in place the court appoints a legal administrator to handle the final affairs.
